The default Pause menu's Save button is actually hard-coded to hide/show itself automatically based on whether or not saving is currently possible due to e.g. the game currently being in a cutscene.
Without this automation, it's necessary to use the Save: Check Action when the menu turns on to check if saving is currently possible.
This auomatic behaviour is based on naming convention, though. If you rename the "SaveButton" to e.g. "_SaveButton", then you'll prevent it from kicking in.
